This Comprehensive Liability & Indemnification Policy (“Liability Policy”) is a legal instrument that defines the scope, limitations, and exclusions of the legal responsibility of Trexplus.com (the “Company,” “we,” “us,” or “our”) toward the User (“Buyer,” “Customer,” or “you”). By accessing our Services, purchasing products, or engaging with our technical support, you irrevocably agree to the terms contained herein. This document is intended to protect the operational integrity of Trexplus.com and should be read in conjunction with our Terms & Conditions and Privacy Policy.

1. Reseller Status & Proxy Liability

Trexplus.com operates strictly in the capacity of a third-party Retailer. We do not manufacture, design, or engineer any of the branded components, peripherals, or systems sold on our platform.

  • Manufacturing Defects: Any liability arising from design flaws, manufacturing errors, or inherent product defects rests solely with the original equipment manufacturer (OEM).
  • Proxy Liability: Trexplus.com shall not be held liable for any damages, whether physical, financial, or technical, caused by the failure of a branded product to meet its advertised performance specifications.

2. Limitation Of Incidental & Consequential Damages

To the fullest extent permitted by applicable law (specifically the laws of India), Trexplus.com, its directors, employees, and affiliates shall in no event be liable for any:

  • Indirect or Consequential Losses: Including but not limited to loss of revenue, loss of anticipated savings, loss of business opportunity, or loss of reputation.
  • Incidental Damages: Any secondary costs incurred by the customer due to a product failure, such as travel expenses to a service center or the cost of temporary hardware rentals.
  • Punitive Damages: Any claims for damages intended to punish or make an example of the Company.

Our total aggregate liability for any single claim shall not exceed the actual purchase price paid by the customer for the specific product that gave rise to the liability.

3. Critical Data Integrity & Loss Disclaimer

Trexplus.com specializes in computing hardware, including storage devices (HDDs, SSDs, NVMe drives).

  • Backup Responsibility: The Buyer assumes 100% responsibility for maintaining regular, redundant, and secure backups of all data.
  • Data Destruction: We shall not be liable for the loss of personal or professional data under any circumstances, including product failure, system crashes during support, or formatting of drives by brand service centers during warranty claims.
  • No Recovery Services: Trexplus.com does not provide data recovery services, and we are not liable for the costs associated with third-party data recovery.

4. Hardware Misuse, Installation, & Overclocking

Computers are complex electronic systems. Trexplus.com disclaims all liability for damages resulting from:

  • Improper Installation: Short circuits, bent CPU pins, or electrostatic discharge (ESD) caused by the Buyer or unauthorized third-party technicians during assembly or upgrades.
  • Overclocking and Stress: Thermal damage or “burning” of PCB components resulting from pushing hardware beyond manufacturer-rated speeds (Overclocking/Undervolting).
  • Environmental Factors: Failure caused by excessive dust, moisture, inadequate ventilation, or use in non-standard environments (e.g., industrial use of consumer-grade hardware).

5. Logistics, Transit, & Third-Party Negligence

While we facilitate the delivery of goods, the actual transport is handled by independent third-party logistics (3PL) providers.

  • In-Transit Damage: Trexplus.com is not liable for damages caused by the negligence or mishandling of courier personnel.
  • Unboxing Requirement: Our liability for “Dead on Arrival” (DOA) or “Missing Items” is strictly contingent upon the Buyer providing a continuous, unedited unboxing video that clearly shows the shipping label and the condition of the package. In the absence of this video, the Buyer assumes all risk for transit-related issues.
  • Delayed Delivery: We are not liable for financial losses caused by project delays or business interruptions resulting from courier-side delays.

6. Electrical Risks & Property Damage

Computer components, particularly Power Supply Units (PSUs) and Graphics Processing Units (GPUs), carry inherent electrical risks.

  • Fire and Electrical Hazards: Trexplus.com disclaims liability for any property damage, fire, or electrical failures caused by defective hardware or unstable domestic power grids (e.g., lack of UPS or earthing).
  • Personal Injury: We are not liable for any bodily harm or injury resulting from the mishandling of electronic equipment, including electrical shocks or burns.

7. “Custom PC Build” Configuration Risks

For customers utilizing our “Custom PC Build” service:

  • Hardware Bottlenecks: We are not liable if the specific combination of parts chosen by the Buyer results in performance bottlenecks (e.g., a slow CPU paired with a high-end GPU).
  • Compatibility Limitations: While our support team tries to warn of incompatibilities, the final choice of components rests with the Buyer. We are not liable for system instabilities caused by incompatible hardware combinations.

8. Digital Products & Software Liability

For virtual products such as Antivirus keys and software:

  • Activation Issues: We are not liable if a software vendor revokes a key due to changes in their global licensing policies.
  • System Errors: We are not liable for “Blue Screen of Death” (BSOD) errors, OS crashes, or software-based data corruption resulting from the installation of software purchased from our platform.

9. Force Majeure (Uncontrollable Events)

Trexplus.com shall be excused from any failure or delay in performance if such failure is caused by an event beyond our reasonable control, including but not limited to:

  • Natural disasters (Heavy rains, landslides, floods, earthquakes).
  • Pandemics, lockdowns, or government-mandated restrictions.
  • Labor strikes, riots, war, or telecommunication network failures.

10. Indemnification Clause

You agree to defend, indemnify, and hold harmless Trexplus.com and its employees from and against any and all claims, damages, costs, and expenses (including legal fees) arising from:

  • Your misuse of the products purchased.
  • Your violation of these policies.
  • Any claim that your use of the products caused damage to a third party.

11. Professional Advice Disclaimer

Any information provided by our staff via chat, email, or phone regarding hardware recommendations is for informational purposes only. It does not constitute a “Guarantee of Performance.” The Buyer is encouraged to perform independent research before making high-value purchases.

12. Governing Law & Exclusive Jurisdiction

This Liability Policy shall be governed by the laws of India. Any legal disputes or proceedings arising out of or related to this policy shall be subject to the exclusive jurisdiction of the courts located in Nadia, West Bengal, India. No other court shall have jurisdiction over matters pertaining to Trexplus.com.
